Judge's Opinion in Amanda Knox Case Will Likely Play Part in Appeal

Seattlepi.com's correspondent in Italy for the Amanda Knox trial(s), Andrea Vogt, has just filed a story on the 427-page ("front and back") judge's opinion, which sheds light on the jury's verdict. Vogt says Judge Giancarlo Massei's document "leaves ample room for a number of criticisms that will likely feature prominently in her upcoming appeal." For her defenders, that day can't come soon enough.

Though the jury came to the conclusion that Knox was involved in the murder, they "disagreed with the murder dynamic that prosecutors put forth," reports Vogt. They believed Guede started the sexual violence and that Knox aided in it to some degree. The forensic evidence against Knox was compelling for the jury.

ABC News says that Massei wrote that Knox "killed her roommate 'without any animosity or feeling of resentment,' and that the grisly homicide was the result of 'casual contingencies.'" That puts the judge in disagreement with the prosecution's theory that Amanda Knox murdered Meredith Kercher because of differing hygienic standards. For Massei, the best explanation is that things got out of hand.

Despite arriving at a substantially different accounting of events, the judge wrote that the prosecution "presents a comprehensive and coherent picture, without holes or inconsistencies."

Gaps and inconsistencies
There are no gaps and inconsistencies in this case because of the extremely consistent way the Perugian police force operates. For example, when they turned their attention to finding the murder weapon, they simply looked at the people who had committed the murder, Raffaele Sollecito and Amanda Marie Knox, and sent some guys over to their apartment to find it. The guys found a penknife belonging to Sollecito in the apartment and took it to the lab for DNA testing. Unfortunately, they realised that this knife didn't fit the fatal wounds nor the bloody impression of the murder weapon left on Meredith's bedsheet. Wishing to avoid inconsistencies, they sent Finzi back to Sollecito's place to get a knife that fitted. According to Fin, he opened the kitchen drawer and saw a knife which looked like the sort of one they needed so he took that. Amazingly, it turned out to be the murder weapon when they stuck some of Meredith's DNA to it in the lab and then tested it. And though it too didn't exactly fit the bloody impression on the bedsheet, any inconsistencies were overcome by the fact that it was about the same shape.
Meanwhile back in the States, a number of Americans looked on through the space in their eyes and saw that nothing untoward had happened here and that Amanda's prosecution was 'correct.' Just to make sure there were no inconsistencies, Finzi also mentioned that when he entered Sollecito's flat, he could smell bleach, which of course was consistent with the fact that it had been at least 8 hours since Sollecito had been there and 5 days since the murder which meant that Sollecito had had 5 days to clean the knife with bleach. This was consistent with the fact that Sollecito probably didn't simply drop the knife down any drain in Perugia because he was still using it to cut the courgettes. This in turn is consistent with the fact that during the 6 days between the murder and the 'discovery' of the murder weapon, Amanda and Raffaele had lived in this apartment and used the knife to do the dinner with. Which accounts for why Amanda's DNA was on it. No inconsistencies there. Are you with me so far. If you are, please send me your name, bank account details etc.

More about gaps
Oh there are two more gaps pointed out by Mario Alessi: the gaps where Amanda Marie Knox and Raffaele Sollecito were supposed to be when Meredith Kercher was being murdered in Perugia back in Nov 07. If they were gaps and not presences, how did Amanda and Raffaele take part in the killing? Perhaps the gaps did it.
Solution: arrest the gaps and put THEM in jail for 26 years!
